JUDGEMENT

(1.) HEARD learned counsel for the petitioner.

(2.) PETITIONER has filed this petition for a direction commanding the Principal Judge, Family Court, Allahabad to stay proceedings of matrimonial petition No. 1118 of 2011, Major Sumit Bana Vs. Smt. Swati Chaudhary filed under Section 13 of the Hindu Marriage Act, 1955.

(3.) THERE is no such law that in case the name of the petitioner or the wife is not recorded in the service book or she is not nominated by the husband, the divorce petition cannot proceed. The departmental formalities have nothing to do with the proceedings for divorce.
