JUDGEMENT

(1.) THIS appeal is focussed as against the judgement and award dated 24.1.2009 passed in M.A.C.P. No. 584 of 2007 by the Motor Accident Claims Tribunal, Kanpur Nagar.

(2.) THE factual matrix of the case as set out in the petition are that on 3.7.2007, the deceased Smt. Geeta Devi Gupta alongwith Smt. Phool Devi of the same village had gone Bank of Baroda, Anwar Gang Branch, G.T. Road, Kanpur. As she came out from the bank at about 1.30 p.m. on the road, a motorcycle bearing no. U.P. 78 B.D. 6418 came from opium Kothi's side. The motorcycle was being driven rashly and negligently had hit Smt. Geeta Devi Gupta causing serious injuries to her and she succumbed to her injuries.
