(1.) THE petitioner had appeared in the Combined State/Upper Subordinate Service Examination, 2011 as a reserved category candidate belonging to the Scheduled Tribe, i.e. Nayak Tribe.

THE contention of the learned counsel for the petitioner is that though in the advertisement there was no such stipulation for submitting a caste certificate which had been issued within six months but while issuing the call letter for interview the petitioner was required to submit such a caste certificate, though he had already submitted a caste certificate issued after the amendment of 2002 in the constitutional order by which Nayak was included as a Scheduled Tribe.

THE contention of the petitioner is firstly that in pursuance of the aforesaid requirement he applied to the Tehsildar on 25.10.2013, but the requisite caste certificate was not issued by the concerned Tehsildar instead he refused to accept the request sent by him by registered post. Being aggrieved he submitted a representation to the District Magistrate, but he also did not take any action in the matter, resultantly, he could not submit the caste certificate as per the requirement of the opposite party and his result was not declared and he was deprived of appointment.
