(1.) BY means of this writ petition, the petitioner, i.e. the Union of India has challenged the judgment and order of the Central Administrative Tribunal, Allahabad Bench, Allahabad dated 11.07.2000 passed in O.A. No.1390 of 1998.
(2.) THE private respondent herein was appointed as a regular store man in the year 1974 by the Chief Engineer, Western Command, Shimla. He was later transferred on compassionate grounds, i.e. on his own request, to Central Command in the year 1982. Consequent to his transfer to the Central Command, the said respondent was placed at Serial No.82 of the seniority list, which was never challenged.
(3.) IT appears that the Engineer -in -Chief, Army Headquarters, New Delhi issued directions for consideration of promotion of the store -men. Accordingly a departmental committee was formed and a list of eligible candidates for promotion to the post of Storekeeper Grade -II was prepared on 23.03.1991. The name of the private respondent, Sri Mathura Dutt did not find place in the said eligibility list, as such he submitted a representation to the concerned authority, which was rejected. Thereafter, an appeal was filed, which was also rejected. Being aggrieved, the private respondent filed the O.A. No.1390 of 1998 before the Tribunal.
