JUDGEMENT

(1.) HEARD Mr.P.K.Srivastava, learned counsel for the petitioner as well as Mr.Upendra Singh, learned counsel for the opposite parties.

(2.) THROUGH the instant writ petition the petitioner has challenged the order of dismissal dated 6.4.1993 (Annexure No.10), passed by the Executive Engineer, Tube -well Electrification Division, U.P.State Electricity Board, Lucknow.

(3.) THE learned counsel for the petitioner submits that the petitioner has been dismissed from service on the ground that he succeeded to get the appointment in the Electricity department on concealment of fact that he was a dismissed employee of the police department, whereas he was issued a charge sheet dated 1st of June, 1992, which contained the charges altogether different to the charge upon which he has been dismissed from service, therefore, the order impugned is based on no inquiry, that being so, is unsustainable.
