By means of this writ petition under Art. 226 of the Constitution of India, it is prayed that show cause notice dated 23rd Sept., 2005, issued by respondent no. 2 to the petitioner, Annexure 3 to the Writ Petition, may be directed not to be given effect to by the respondents and be quashed by this Court.
(2.) Heard Sri Vipin Kumar Saxena, counsel for the petitioner, Sri K.C. Sinha, Additional Solicitor General of India representing respondent nos. 1, 4 & 5 and Sri B.N. Singh counsel for the respondent nos. 2 and 3.
(3.) The wood-cut profile of the case is that the petitioner is Phone Mechanic in Bharat Sanchar Nigam Ltd., Aligarh. He and one Sri Naresh Pal Singh were caught red handed taking bribe on 13.9.1997 by the Central Bureau of Investigation (for short "C.B.I'). A First Information Report was accordingly lodged against them.
