JUDGEMENT

(1.) THE present writ petition has been filed under Article 226 of the Constitution of India, inter alia, praying for quashing the judgment and order dated 21.10.2000 (Annexure -5 to the writ petition) and the order dated 10th October, 2003 (Annexure -7 to the writ petitions) passed by the learned Vth Additional District Judge, Kanpur Nagar (Appellate Authority). The dispute relates to an accommodation situated on the First Floor of House No. E -49, Khapra Mohal, Kanpur Nagar. The said accommodation has, hereinafter, been referred to as "the disputed accommodation."

(2.) FROM a perusal of the averments made in the writ petition and the annexures thereto, it appears that the respondent filed a release application under section 21(1)(a) of the U.P. Act No. 13 of 1972 (in short "the Act") against the petitioner for the release of the disputed accommodation. The said release application was registered as Rent Case No. 151 of 1982.

(3.) THEREUPON , the petitioner filed an appeal under section 22 of the Act, which was registered as Rent Appeal No. 32 of 1986. A certified copy of the memorandum of appeal of the said Rent Appeal No. 32 of 1986 has been filed as Annexure -2 to the writ petition.
