JUDGEMENT

(2.) THIS application under Section 482 Cr. P. C. has been filed for quashing the complaint filed against the petitioner and the impugned summoning order dated 20-12-2003 passed by the learned Magistrate.

(3.) FROM a perusal of Annexure-II, I find that permission for cutting the trees grown in the village Kishunapur (Madaripur) was granted and the summoning order also shows that complaint was also lodged in respect of the trees grown in the village Kishunapur (Madaripur ). Thus it is found that the applicant cut only those trees for which permission was granted by the District Horticulure Officer, Lucknow.
