VARAD ULLAH Vs. STATE OF U P

Decided On November 05, 2004
VARAD ULLAH Appellant
V/S
STATE OF UTTAR PRADESH Respondents

JUDGEMENT

(1.) M. A. Khan, J. Heard learned Counsel for the parties and I have gone through the record.

(2.) IT appears that there was contract between the parties for supply of leather and leather goods. IT appears, however, that certain dispute arose between the parties and then it resulted into civil litigation. Civil litigation has already been ended as the suit has already been decreed against the petitioner. A revision against that order has also been decided by the High Court and the order passed by the learned Civil Court has been apparently allowed.

(3.) THE petition under Section 482 Cr. P. C. is thus allowed and the prosecution of the petitioner in Criminal Complaint Case No. 1311 of 2000, M/s. Super House Leather Ltd. v. M/s. Prima Impex International and others, pending in the Court of Chief Judicial Magistrate, Unnao, is hereby quashed. Petition allowed. .
