JUDGEMENT

(1.) M. P. Singh, J. Heard the learned Counsel for the parties and perused the materials on record.

(2.) THE learned Magistrate dismissed the application under Section 156 (3) Cr. P. C. of the revisionist to lodge a F. I. R. against the accused persons. THE learned Magistrate dismissed the application of the revisionist on 5-2-04. THE police without obtaining the order of the Magistrate conducted the investigation.

(3.) THIS revision stands thus allowed with the aforesaid observation. Revision allowed. .
