JUDGEMENT

(1.) THE present contempt petition has been filed under section 12 of the Contempt of Courts Act, 1971 by the petitioner/applicant, inter alia, praying for initiating contempt proceedings against the opposite party (Smt. Stuti Kakkar). By the order dated 13.4.1993, notice was directed to be issued to the said opposite party on the contempt petition. Again, by the order dated 16.7.1993, fresh notice was directed to be issued to the said opposite party.

(2.) IN response to the notice issued pursuant to the said order dated 16.7.1993, appearance was put in on behalf of the said opposite party (Smt. Stuti Kakkar), and time was taken for filing counter affidavit as is evident from the order dated 3.9.1993 passed on the order -sheet.

(3.) HOWEVER , thereafter, an application being Civil Misc. (Withdrawal) Application No. 65659 of 1998 (Dated 23.10.1998) was filed on behalf of the petitioner/applicant. It is, inter alia, prayed in the said application that the notices issued against the opposite parties be discharged and the contempt petition be dismissed as infructuous.
