SWAMI NATH Vs. GAON SABHA

JUDGEMENT

(1.) The facts are : A lease of fishing rights in pond No. 425 area 8.35 acres was granted for 10 years to swaminath Sharma. The lease fell on 30-6-1988. Three applicants lay a claim to fresh allotment. (1) Jal Mazdoor Mats Jivi Sahkari Samiti (2) Mats Jivi Sahkari Samiti Ltd. (3) Swaminath Sharma.

(2.) On 8-2-1988 Naib Tahsildar recommends in favour of jal Mazdoor Mats Jivi Sahkari Samiti. Accordingly on 14-11-1988 Sub-Divisional Officer executed a lease.

(3.) Aggrieved by the order of fresh allotment, two revision are to protest irregular process. Additional Commissioner finds that allottee Samiti is now a defunct body ; that resolution of Land Management Committee dated 12-5-1988 is apt for Swaminath Sharma. So he submits a reference to set aside order of Sub-Divisional Officer dated 14-11-1988 ad to grant lease for 10 years at Rs. 21,000.00 to Swaminath Sharma. On 19-2-1991 Honourable Member Shri R.P. Gupta discharge the reference ruling that revision will not lay.
