JUDGEMENT

(1.) The aforesaid writ petitions pertain to the dispute regarding the election of the office bearers of Jan Samaj Vidyapeeth Uchchattar Madhyamic Vidyalaya Digamberpur, Post Office Mubarakganj, renewed on 20.3.1984 for two years with effect from 10.10.1983. On 16.12.1985 an application for renewal of the above Society was made by one Bachchu Singh as adhyaksh of the Society. At that time there was no dispute regarding the office bearers of the above Society. Thereafter on 24.11.1987 he submitted the copy of the proceeding of a meeting which was alleged to be held on 7.6.1987 claiming himself to be the Manager before the Deputy Registrar of the Society. subsequently, Kesho Ram Verma opposite party No. 5 in writ petition No. 3955 of 1989, claiming himself to be elected as President in the elections, held on 21-6-1987, filed the proceedings of the meeting of the General Body before the Deputy Registrar of the Societies. The Deputy Registrar of the Societies having arrived to a conclusion that from the aforesaid documents, it appeared that there existed dispute with respect to the office bearers of the said registered Society, each claiming to have been elected in the elections held on different dates, referred the dispute under Sec. 25 (1) of the Societies Registration Act for a decision by the Prescribed Authority/Sub-Divisional Officer, Sadar, Faizabad.

A petition under Sec. 25, which was moved by 15 members of the Society, as well as by the registered Society it self and the reference made by the registered Societies was decided together by the Prescribed Authority by means of the order dated 10-4-1989 contained in Annexure-12 to the writ petition.

(3.) The above dispute arose between the office bearers of the above referred Society representing the Committee of Management, the petitioner of Writ Petition No. 814 of 1983. According to him Sri Siya Ram Verma ceased to be the member of the Society after the elections held on 21-6-1987 and Siya Ram Verma claimed to be elected in another meeting. Ram Tej Verma was no where in the aforesaid dispute.
