JUDGEMENT

(1.) The facts at the preliminary stage are ; Naseer Uddin's institute a declaratory law suit under Sec. 229-B, Z.A. and L.R. Act in the court of Assistant Collector First Class. The suit has begun and no written statement has been filed by defendant Mohd. Wasil's.

(2.) On 20-11-1992 plaintiff Naseer Uddin's move an application under Sec. 229-D of Z.A. an L.R. Act that defendants be commanded not to interfere with their peaceful possession over the land. Also not to get entry recorded of their names in revenue records.

(3.) On 30-11-1992 defendant Mohd. Wasil's file an objection contending absence of evidence supporting plaintiff's title or possession. It is claimed they are in undisturbed possession and the order will encroach upon their subsisting interest. The relief to dismiss the application is prayed for. On 6-4-1993 Shri Nikhil Chandra Shukla, learned Sub-Divisional Officer, Meerut enters an order directing the parties to maintain status quo.
