JUDGEMENT

(1.) Supplementary affidavit filed today in the Court, be taken on record. Sri Amit Mahajan, Advocate appears on behalf of the respondents prays for and is granted six weeks time to file counter affidavit.

(2.) List in the first week of July, 2013.

(3.) Sri Nikhil Agrawal, learned counsel for the appellant submits that an interim order is urgently required as the appellant is in process of making export worth Rs. 40,00,000,00/- (Rupees Forty Crore). If in the meantime the recovery is pressed against the appellant, the entire business shall come to stand still and it will cause irreparable loss and injury to the appellant. Having regard to the facts and circumstances of the case, it is provided by way of interim measure that if the appellant deposits a sum of Rs. 3,00,000,00/- (Rupees Three Crore) in cash and furnishes security other than cash or bank guarantee to the extent of Rs. 9,00,000,00/- (Rupees Nine Crore) to the satisfaction of the respondent no. 2, the recovery against the appellant shall not be pressed in the meantime.
