(1.) Heard Sri Rishi Kant Rai, counsel for the petitioner and Arvind Kumar Shukla, counsel for respondents-3 to 6.
(2.) The writ petition has been filed for quashing the order of Deputy Director of Consolidation, Deoria (respondent-1) dated 20.04.1981 passed in Revision No. 952, Rama Shankar and others Vs. Ram Kripal and others and order of Consolidation Officer Ramkola, Deoria (respondent-2) dated 16.05.1978 passed in Case Nos. 1597- 1602, Ram Kripal and others Vs. Amrish and others in a proceeding under Section 9-A of U.P. Consolidation of Holdings the Act, 1953 (hereinafter referred to as the Act).
(3.) Before the Consolidation Officer, dispute related to basic year Khata Nos. 2, 10, 78 and 80 of village Pakari Bantir alias Sonha, tappa Papaur, pargana Sidhuwa Jobna, district Deoria. Respondent-3 to 6 have lost their claim in respect of khata No. 10 before all the consolidation authorities and have not filed any writ petition as such there is no dispute in respect of khata No. 10 in this writ petition. Dispute before this Court is in respect of the land of khata Nos. 2, 78 and 80. In basic consolidation year khata No. 2 was recorded in the names of Amrish, Krishna Kant sons of Jugul, Sitaram, Ramjee sons of Rajbansi, Rambali, Rajaram sons of Vindhyachal, Venkateshwar son of Dalsingar, Kedar, Ramanand, Ramashankar sons of Banshu, Mahatim son of Tilak, Paramjeeta widow of Munna as grove holders. Khata No. 78 was recorded in the names of Kedar, Ramanand, Ramashankar sons of Banshu, Mahatim son of Tilak, Ram Kripal son of Rudal and Smt. Kaushalya widow of Sangam as sirdar. Khata No. 80 was recorded in the names of Ram Kripal son of Rudal and Smt. Kaushalya widow of Sangam as sirdar. In this writ petition the dispute is between the petitioners and Rama Shankar, Shiv Pujan, Rajendra and Bhagwan (respondents-3 to 6) whose names were not recorded over any khata of the land in dispute. There is no dispute with respect of shares of other recorded persons in the basis consolidation year in this writ petition with the petitioners.
