JUDGEMENT

(1.) HEARD learned counsel for the applicant and learned A.G.A. The present 482 Cr. P.C. petition has been filed for quashing the summoning order dated 08.10.2009 passed in Criminal Case No. 7933 of 2009 under Section 302 I.P.C., Police Station Chhaprauli, District Baghpat, pending before learned Chief Judicial Magistrate, Baghpat.

(2.) IT is contended by learned counsel for the applicant that the applicant had no knowledge about pendency of the present proceedings, therefore, there is no laches on the part of the applicant in approaching this Court.

(3.) THE contention of the counsel for the applicant is that no offence against the applicant is disclosed and the present prosecution has been instituted with a mala fide intention for the purposes of harassment. He pointed out certain documents and statements in support of his contention.
