JUDGEMENT

(1.) Heard Sri S.K. Chaubey, learned counsel for the defendant-petitioners and Sri P.K. Srivastava, learned counsel for the sole plaintiff. Since all the respondents are represented with the consent of learned counsel for both the parties this writ petition is being decided finally today itself.

(2.) A short counter affidavit has been filed by learned counsel for the plaintiff respondent today. Let the same be taken on record. Learned counsel for the defendant-petitioner states that he does not intend to file any rejoinder affidavit.

This writ petition is directed against the order dated 12.08.2011 passed by the Civil Judge (Jr. Division) Kaushambi in Restoration Application No.71/74 of 2010 filed in Original Suit No. 113 of 2002 (Nawal Prasad Vs. Dhirendra Kumar & others) as also against the order dated 04.07.2013 passed by the District Judge, Kaushambi in Civil Revision No. 18 of 2011 (Dhirendra Kumar & others Vs. Nawal Prasad) whereby he has dismissed the revision filed by the defendant-petitioners.
