JUDGEMENT

(1.) Supplementary affidavit filed today on behalf of the applicant be taken on record. The present bail application has been moved on behalf of the accused - applicant for enlarging him on bail in Case Crime No.177 of 2012, under Sections 420, 467, 468, 471, 506, 120 -B, 406 IPC, P.S. Vijay Nagar, District Ghaziabad.

(2.) Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. It has been argued on behalf of the accused -applicant that the case of the accused -applicant is similar to that of co -accused Shyam Singh, who has been granted bail by another Bench of this Court vide its order dated 28.8.2012 passed in Criminal Misc. Bail Application No.21083 of 2012, because forged account is said to have been opened in the name of Vipin Kumar Pal and that the role of the applicant and that of co -accused Shyam Singh is said to be that of conspiracy only, so on the ground of parity with co -accused Shyam Singh, the accused -applicant should also be enlarged on bail.

(3.) The learned A.G.A. has opposed the prayer for bail but has conceded that the case of the accused -applicant is similar to that of co -accused Shyam Singh. Since the case of the accused -applicant is similar to that of co -accused Shyam Singh, who has been granted bail by the another bench of this court so on the ground of parity the applicant also deserves to be enlarged on bail.
