JUDGEMENT

(1.) S. P. Mehrotra, J. This writ petition under Article 226 of the Constitution of India has been filed by the petitioner, inter alia, praying for quashing the order dated 14-8-2003 (Annexure-3 to the writ petition) passed by the learned Additional District Judge (Court No. 4), Gorakhpur/appellate Authority.

(2.) FROM the averments made in the writ petition, it appears that the respondent filed a release application under Section 21 (1) (a) of the U. P. Act No. XIII of 1972 (in short "the Act") for the release of the shop in question. The said release application was registered as P. A. Case No. 32 of 2000.

(3.) THEREUPON, it appears that the petitioners filed an appeal under Section 22 of the Act, which was registered as Rent Appeal No. 16 of 2002.
