JUDGEMENT

(1.) THE present writ petition has been filed by the peti­tioner Article 226 of the Constitution of India, inter alia, praying for quashing the order dated 22.9.2003 (Annexure No. 6 to the writ petition) passed by the learned Civil Judge (Senior Division)/Prescribed Authority, Badaun.

(2.) THE dispute relates to an accommodation situated in Mohalla Shahbazpur, Chauraha near Tikatganj, Badaun, the details whereof are given in the release application referred to hereinafter. The said accommodation has hereinafter been referred as "the disputed accommodation".

(3.) DURING the pendency of the said release application, the said Ram Narain expired and the respondent Nos. 1 and 2 herein were substituted as the heirs and legal representatives of the said Ram Narain.
