JUDGEMENT

(1.) ONKARESHWAR Bhatt, J. This revision has been directed against order dated 2-4-1998 passed by the then Sessions Judge, Ballia in Criminal Revision No. 230 of 1997, Ram Bahadur v. State of Uttar Pradesh and others.

(2.) SRI Awdhesh Tiwari learned Counsel of the revisionist, SRI Kameshwar Singh, learned Counsel for the opposite parties and the learned A. G. A. have been heard.

(3.) IN view of on the aforesaid discussion, the revision is allowed and the order dated 2-4-1998 passed by the Sessions Judge, Ballia in Criminal Revision No. 230 of 1997 is set aside and the order dated 16-9- 1995 passed by the Sub-Divisional Magistrate, Rasra, District Ballia is restored.
