GANGA RAM Vs. JUDGE SMALL CAUSES COURT MORADABAD

JUDGEMENT

(1.) THE present writ petition under Article 226 of the Constitution of India has been filed, inter alia, praying for quashing the judgment and order dated 2952003 (Annexure No. 3 to the writ petition) passed by the learned Judge Small Cause Court, Moradabad in SCC Suit No. 5 of 2001.

(2.) THE dispute relates to an accommodation situated in Mohalla Budhi Mata, Kasba Chandausi, District Moradabad, the details whereof are given in the judgment and order dated 2952003 referred to hereinafter. The said accommodation has hereinafter been referred to as the “disputed accommodation.”

(3.) IT further appears that by the judgment and order dated 295 2003 passed by the learned Judge, Small Cause Court, Moradabad, the said SCC Suit No. 5 of 2001 was decreed exparte. Copy of the said judgment and order dated 2952003 has been filed as Annexure No. 3 to the writ petition.
