(1.) THIS is a revision under section 219 U.P. Land Revenue Act filed by Shri Hari Shanker Pal, Ram Shanker Pal and Hargovind Pal s/o Gaya Prasad residents of village Vijankhera Tahsil and Pargana Ghatampur District Kanpur Nagar against the order dated 24.2.2009 passed by Tahsildar (Judicial), Ghatampur in mutation suit No. 400/100, Hari Shanker v. Mangal Singh, 34/35 L.R. Act.
(2.) THE contention of the revisionists that they had purchased the disputed land from the original tenure holder Mangal Singh through two registered sale-deeds executed on 4.6.2001 and 7.7.2005 respectively and thereafter had submitted the mutation applications in the Court of Tahsildar. Since no objection was received, the mutation was allowed by the Tahsildar through his judgment dated 8.5.2008. However, subsequently a time-barred application was filed by the respondents on 20.12.2008 for restoration and the same was allowed by the Tahsildar on 24.2.2009. The present revision has been filed by the revisionist against this order for restoration with the contention that it was non-speaking and against the basic tenets of justice as no opportunity of hearing was allowed to him.
(3.) I have heard the arguments put forwarded by the learned Counsels of both the parties as well as have perused the Lower Court records.
