(1.) The matter involved in this writ petition is of grave importance and urgency as it relates to offer of the petitioner to donate his kidney to save the life of the proposed recipient.
(2.) The petitioner is a permanent resident of Village Noorpur, Tehsil Chandpur, District Bijnor. For the last four-five years he has been residing and doing business as vegetable vender in Kolkata (West Bengal) where he came into contact with the family of the proposed recipient, Gaurav Jain, whose father helped the petitioner in establishing his business in Kolkata. On coming to know of the failure of the kidneys of Gaurav Jain, the petitioner offered to donate his kidney. On such basis an application was moved by Sri Surendra Kumar Jain (father of the proposed recipient Gaurav Jain) and the petitioner, which was received in the office of the Commissioner, Moradabad Division, Moradabad on 4.12.2010. On such application, proceedings were initiated and ultimately the hospital, where the kidney transplantation was to be undertaken, was informed by the communication dated 8.2.2012 that the application of the petitioner for donation of his kidney has been rejected by the State Level Authorisation Committee in its meeting held on 20.1.2012. Challenging the said communication/order, this writ petition has been filed. A further prayer has been made for a direction to the respondents to grant permission to the petitioner to donate his kidney to Sri Gaurav Jain on humanitarian ground.
(3.) We have heard Sri Rajeev Kumar Saini, learned counsel for the petitioner as well as Sri Harish Chandra Pathak, learned Standing Counsel appearing for the respondents and have perused the record. Pleadings have been exchanged and with consent of the learned counsel for the parties, this writ petition is being disposed of at the admission stage itself.
