JUDGEMENT

(1.) Though the order impugned before us being order dated 13.8.2012 passed by learned Single Judge in Writ C No. 41977 of 2002, Smt. Raj Kumari and others v. Upper Ayukta and others, arising out of revision pending before the appropriate Additional Commissioner, Meerut Division Meerut, respondent No. 1 herein against the order of Sub Divisional Officer under the Land Revenue Act, 1901, we are of the view that such revision has been treated to be infructuous by the Court itself to follow the order. Propriety demands that the matter is required to be interfered by this Court and the same is modified to the extent that in view of the order passed in Writ Petition No. 28991 of 1998, Mool Chand v. Collector, Ghaziabad, being dated 16.9.1998, it is open for the Additional Commissioner, Meerut Division Meerut to consider the cause upon giving fullest opportunity of hearing to the parties and by passing a reasoned order thereon within a period of one month from the date of communication of this order in accordance with law. The writ petition is disposed of, at the stage of admission, however, without imposing any cost.
