JUDGEMENT

(1.) Akhtar Hussain has filed this civil writ petition for issuance of a writ in the nature of certiorari for quashing select list dated 10.12.2009 published by U.P. Secondary Education Service Selection Board, Allahabad so far as it relates to selection to the post of Principal, Janta Inter College, Nanpara, District Bahriach. The petition further prays for issuance of a writ in the nature of mandamus directing the respondents to hold fresh selection and allow the petitioner to compete for the post of Principal of the Institution in question and further restraining the respondents from making appointment to the post of Principal of the Institution.

(2.) Learned counsel appearing for the U.P. Secondary Education Service Selection Board, Allahabad (respondent no.4) does not dispute the facts and, therefore, counter affidavit has not been filed.

(3.) Undisputed facts are that the petitioner was serving as a Lecturer on regular basis in Janta Inter College, Nanpara, District Bahriach and was eligible for selection and appointment of Principal in the year 2009 being the second senior most teacher in the college/ respondent no.5.
