(1.) Heard learned counsel appearing on behalf of the appellant and gone through the records as well as the judgment and order impugned in the present appeal.

This second appeal under Sec. 100 of Code of Civil Procedure has been preferred against the judgment and decree dated 02.04.2009, passed by learned District Judge, Faizabad in civil appeal no.59 of 2008 by which the appeal filed by the respondents, who were defendants before the learned trial Court, was allowed by learned District Judge setting aside the judgment and decree dated 19.05.2008 passed by learned Civil Judge (Jr.Div.)-V, Faizabad in regular suit no.576 of 2001, which was filed by the appellant/plaintiff for permanent injunction.
(3.) Learned counsel for the appellant failed to establish that there is any substantial point of law involved in this appeal. Mere re-appraisal of evidence or its interpretation thereof is not permissible under Sec. 100 of Code of Civil Procedure.
