JUDGEMENT

(1.) HEARD Mr. Amit Bose, learned counsel for petitioner as well as Mr. P.K. Rai, learned Standing Counsel and perused the record.

(2.) THE writ petition has been filed challenging the order dated 28.10.1980, a copy of which is annexed as Annexure no. 10 to the writ petition. The petitioner has also sought a direction to the respondents to immediately release the entire post retiral dues of the petitioner including final pension after granting him super - selection grade w.e.f. 29.12.1990 and second super selection grade w.e.f. 1.03.2000 as well as assured career promotion w.e.f. 01.12.2008 together with arrears of pay and allowances for the period the petitioner was placed under suspension with effect from 09.5.1994 to 30.8.1996 and 14.06.2008 to 05.08.2008.

(3.) IN this regard, due to pendency of criminal case, departmental proceedings were also initiated and the petitioner was placed under suspension. However, by order dated 29.08.1996 of the Senior Superintendent of Police, Varanasi, the petitioner was reinstated in service without prejudice to any departmental proceedings being conducted against him.
