JUDGEMENT

(1.) I have heard Sri Faujdar Rai, learned counsel for the appellant and Sri N. B. Nigam, learned counsel for the respondent and have perused the record.

(2.) This is a plaintiff's appeal against the judgment and decree dated 19.10.1978 passed by 6th Additional District Judge in Civil Appeal No. 10 of 1978 arising out of Civil Suit No. 48 of 1976.

(3.) Civil Suit No. 48 of 1976 was instituted for directing the defendant to specifically perform the contract of re-conveyance contained in the sale-deed dated 29.03.1974 and to execute the sale-deed in favour of the plaintiff after receiving Rs. 6,000/- from the defendant within such period, as specified by the Court.
