JUDGEMENT

(1.) ONKARESHWAR Bhatt, J. Appellants Chhatrapal (aged about 25 years), Jasiram (35 years), Bali Singh (22 years), Mahendra (19 years) and Gajadhar (48 years) have been convicted and sentenced under Section 302 read with Section 149, I. P. C. to undergo rigorous imprisonment for life, under Section 307 read with Section 149, I. P. C. to undergo seven years rigorous imprisonment and under Section 148, I. P. C. to undergo two years rigorous imprisonment. The sentences were ordered to run concurrently. The order of conviction and sentence has been passed in Sessions Trial No. 299 of 1980 by the then IInd Addl. Sessions Judge, Hamirpur on 23- 2-1985.

(2.) SRI Gopal Chaturvedi, learned Senior Advocate, appearing for the appellants, and learned A. G. A. appearing for the State have been heard.

(3.) MOOL Chand prepared a written report of the occurrence at his house and at 7. 20 p. m. on 27-7-1980 First Information Report of the case was lodged at police station Rath. Distance of the police station from the place of occurrence is about there kilometers.
