(1.) -Heard learned counsel for the parties.

(2.) THE facts of this case are covered by the Division Bench judgment of this Court in Rakesh Shukla v. District Magistrate, 2002 (3) AWC 2397 : 2002 (48) ALR 651.

(3.) IN cases where the petitioner does not dispute his liability to pay but only claims that the recovery cannot be made as arrears of land revenue, he really wishes to delay the payment. If a suit is to be filed for recovery of the amount it will take years and years to decide, because it is well known that suits take a long time to decide in our country. The Court should not exercise its discretion in favour of such persons who do not deny the liability to pay but only want to delay the payment by contending that the recovery cannot be made as arrears of land revenue.
