JUDGEMENT

(1.) This revision has been preferred by revisionist Ram Saran against the judgment and order dated 8.12.1987 passed by Sessions Judge, Jhansi in Criminal Appeal No. 85 of 1985 dismissing the appeal of the revisionist and up- holding the order of conviction and sentence passed by Judicial Magistrate I, (Economic Offences) Jhansi dated 9.4.1984 in Criminal Case No. 24 of 1985 convicting and sentencing the revisionist under Sec. 7(i) read with Sec. 16 (1)(a)(i) of the Prevention of Food Adulteration Act, 1954 (hereinafter referred as the Act) to undergo rigorous imprisonment for six months and to pay a fine. of Rs. 1000.00 and in default of payment of fine, to further undergo rigorous imprisonment for three months.

(2.) Heard Sri V.P. Mathur, learned counsel for the revisionist and the learned A.G.A. appearing for the State.

(3.) I have gone through the judgment and orders passed by the learned Sessions Judge, Jhansi and the learned judicial Magistrate, Jhansi. The revisionist was found selling turmeric whole. The prosecution has examined P.W. 1 Food Inspector, P.W.2 V.N. Chaubey, P.W. 3 Sri Balwan Singh and P.W. 4 Lal Shah Food Clerk. Exhibit Ka-1 is the purchase receipt of the sample, Exhibit Ka-2 is the report and Ext. Ka 3 is the report. of the Public Analyst. Also perused Ext. Ka. 4, Ka. 5, Ka. 6,7,8,9 and Ext. Ka. 10.
