MANAGING COMMITTEE, SRI URIA BABA ADARSH UCHCHATAR MADHYAMIC VIDYALAYA (HARAKUA), VARANASI Vs. DISTRICT INSPECTOR OF SCHOOLS, VARANASI AND OTHERS

JUDGEMENT

(1.) The Committee of Management of Sri Uria Baba Adarsh Uchchatar Madhyamik Vidyalaya has filed this petition challenging the order of the District Inspector of Schools dated 10-10-1 80 and 14-10-1980 directing it to allow the respondents Nos. 3 and 4 to attend the institution and to pay their salary. On a perusal of Annexure 3 to the petition, it is apparent that on June 24, 1980, the District Inspector of Schools had passed a detailed order directing the Committee of Management is allow respondents Nos. 3 and 4 to join their duties and to pay their salary as they were permanent teachers. That order was passed alter giving opportunity to the petitioner. The order of the District Inspector of Schools dated June 24, 1980, has however not been challenged in this petition, instead the subsequent order which was in the nature of reminder for complying with the order dated June 24, 1980, has been challenged. Since the initial order dated June 24, 1980, has not been challenged and only the subsequent order is challenged, the petitioner is not entitled to any relief.

(2.) In the result the petition fails and is accordingly dismissed. The interim order stands discharged. Petition dismissed.
