SHEESH PAL Vs. THE STATE

JUDGEMENT

(1.) This revision has been filed by Sheesh Pal who was convicted for an offence under Sec. 7/16 of the Prevention of Food Adulteration Act (briefly the Act) and sentenced to undergo rigorous imprisonment for six months and to pay a fine of Rs. 1000.00.

(2.) Sri K.D. Tyagi, Food Inspector Garh Mukteshwar found the present applicant selling she-buffalo milk at the Garh Mukteshwar Chopla in the evening of 31-12-1976. The Food Inspector took a sample of this milk for analysis after observing the rules. The Public Analyst reported that the sample was deficient in fat by 32 per cent and in non-fatty solids by 26 per cent. The Chief Medical Officer accorded sanction and then the present applicant was prosecuted. He was convicted as aforesaid by the Magistrate. An appeal filed by the applicant was also unsuccessful. Hence this revision.

(3.) Learned counsel for the applicant has not made any submission on the merits of the case. He has prayed for a reduction in the sentence.
