(1.) This appeal is directed against the decision of the Additional Civil Judge in Civil Appeal No. 648 of 1963.
(2.) The facts giving rise to this appeal are, in brief, as follows:-
(3.) The State contested the suit and denied all the allegations made by the plaintiff. It was alleged that the proceedings of the departmental inquiry were in conformity with the Police Regulations and Art. 311 (2) of the Constitution and that the Enquiry Officer was fully competent to conduct the inquiry. It was urged that the suit was barred by Sec. 21 and 42 of the Specific Relief Act and Sec. 80 of the Civil Procedure Code. The jurisdiction of the Court was also challenged.
