JUDGEMENT

(1.) Shri Man Mohan Singh, learned counsel for the petitioner submits that the grievance raised in the present writ petition has already been adjudicated by this Court vide judgment delivered on 13.2.2019 in Writ Petition No. 26100 of 2018 ( Dr. Gangesh Dixit and others Vs. State of U.P. and others). It is prayed that similar protection be granted to the present petitioner also.

(2.) Learned Standing Counsel, appearing for the State however submits that individual case will have to be examined to ascertain as to whether claim of the petitioner is covered by that adjudication made in Dr. Gangesh Dixit (supra). It is also urged that facts could have to be verified regarding continuance of petitioner under Government Order dated 7.4.1998 on honorarium basis.

(3.) It goes without saying that the authorities of the State would be at liberty to examine individual facts of writ petitioner.
