JUDGEMENT

(1.) Present writ petitions have been filed by the direct recruits appointed on the post of Assistant Engineer (Civil) in the Department of Irrigation and Water Resources, Government of U.P. assailing the office memorandum bearing No.349 dtd. 12/6/2020 (hereinafter referred to as the 'impugned Office Memorandum') issued by Principal Secretary, Department of Irrigation and Water Resources, Government of U.P. rejecting the objections preferred by the petitioners in respect of en-bloc placement of 250 promotees Assistant Engineers (Serial Nos.484 to 733) in the tentative seniority list dtd. 1/3/2019 above the direct recruits Assistant Engineers.

(2.) Services of the petitioners as well as private respondents are governed under U.P. Services of Engineers (Irrigation Department) (Group 'B') Service Rules, 2007 (hereinafter referred to as 'Rules, 2007'). Post of Assistant Engineer in the Irrigation Department of Government of U.P. comes within the purview of Uttar Pradesh Public Service Commission (hereinafter referred to as 'the Commission').

The Commission issued an advertisement bearing No.A-5/E-1/2011 for conducting Combined State Engineering Service Examination, 2011 for making selection to various posts of Assistant Engineers (Civil) including 190 vacancies in the department of Irrigation and Water Resources. Selection process was in two part i.e. Written Examination and Interview. The Written examination was conducted between 22/4/2013, 24/4/2013 and 25/4/2013. Result of the written examination was declared by the Commission on 20/5/2016. Second stage of the selection process i.e. Interview was scheduled from 15/6/2016 for the candidates who had qualified the Written Examination. On 4/7/2016, final result of the Combined State Engineering Service Examination, 2011 was declared by the Commission and the petitioners were selected for appointment on the post of Assistant Engineer.
