JUDGEMENT

(1.) Heard Mr. Anand Dubey, learned Counsel for the Petitioner as well as Mr. Rajendra Kumar Dwivedi, learned Additional Government Advocate.

(2.) The Petitioner has prayed for quashing the proceedings of Sessions Trial No. 56 of 2010 pending before the court of Sessions Judge , Ambedkar Nagar by applying the principles of Stare decisis on the ground that co-accused Rajesh Rajbhar has already been acquitted from the same charge by means of order dated 28th of March 2006 passed by the Additional Sessions Judge (Fast Tract), Ambedkar Nagar in Sessions Trial No. 73 of 2004.

(3.) The submissions of learned Counsel for the Petitioner based on the principles of 'Stare Decisis'.
