ORIENTAL INSURANCE CO.LTD. Vs. SONKALI

JUDGEMENT

(1.) Sri Manik Chandra Mishra (the deceased) was going on moped on 30th December, 1992 in Village Dabar, Police Station, Meja, District Allahabad. At about 18:00 hours, he was hit from behind by the Tractor No. UP-70A-9318 (the Tractor). In this accident, he received fatal injuries and died.

(2.) His widow and his sons (the claimants) filed Motor Accident Claim Petition No. 286 of 1993. This was allowed by Motor Accident Claims Tribunal, Court No. 19, Allahabad (the Tribunal) on 7th November, 1998.

(3.) The Oriental Insurance Co. Ltd., Mirzapur Road, Naini, Allahabad (the Company) was insurer of the Tractor. It has filed this appeal against the same.
