(1.) THE FACTS

(2.) An FIR of the incident was also lodged by the brother of the Deceased at 17:00 hours. It was registered as case Crime No. 31 of 1994 under Sections 279 and 304 IPC, PS Puramufti, district Allahabad. In the FIR, the Truck namely DIG-1536 was mentioned.

(3.) The mother of the Deceased (the Claimant) filed Claim Petition No. 262 of 1994. In order to prove her claim, she examined herself as PW-1 and Sri Moti Lai (an eye-witness) was examined as (PW-2).
