JUDGEMENT

(1.) 2. Applicant Salim @ Lalle, who is in jail in connection with FIR No. 73 of 2010, relating to offences punishable under Section 420, 467, 468, 471 of I.P.C., police station Bazpur, District Udham Singh Nagar, has sought his release on bail. 3. Heard learned counsel for the parties. Learned counsel for the applicant submitted that from the first information report it is clear that it was co-accused Ram Dayal who accepted the amount of Rs. 3,50,000/- from the complainant. Complainant has alleged that he was promised by the accused Ram Dayal that he would be provided job with Food Corporation of India. It is submitted on behalf of the applicant that complainant himself has indulged in corrupt practice, and that applicant is not the person who accepted the money. The case is triable by Magistrate, and applicant is in jail for last five months. 4. In the above circumstances, without expressing any opinion as to the merits of the case, this court is of the view that the applicant deserves bail. The bail application is allowed. 5. Let the applicant Salim @ Lalle be released on bail on his executing a personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Chief Judicial Magistrate, Udham Singh Nagar.
