JUDGEMENT

(1.) Heard the learned counsel for the applicant, learned A.G.A. and perused the record.

(2.) The instant petition has been filed by the applicant with a prayer to direct the court below to decide the Complaint Case No. 821/10 of 1998, under Section 138 Negotiable Instruments Act pending in the court of Additional Chief Judicial Magistrate-III, Muzaffar Nagar.

(3.) It is submitted by the learned counsel for the applicant that the applicant is the complainant who has filed the complaint against the respondent no. 2 on 21.5.1998 in respect of dishonur of cheque of Rs. 4,80,000/- dated 16.4.1998, which was dishonoured by the Bank on 21.4.1998.
