JUDGEMENT

(1.) Heard learned Counsel for the parties.

(2.) This Second Appeal was admitted on 9.2.1978 without framing any question of law. However, on 14.7.2011 when the hearing took place, before the start of the main arguments and just after statement of the points involved in the appeal by learned Counsel for the Appellant the court was of the opinion that the following two substantial questions of law were involved in the appeal:
