(1.) HEARD Sri Saurabh Srivastava, learned Counsel for the revisionist and Sri Manish Tandon, learned Counsel for the respondent. The present revision has been filed against order dated 21.2.2008 passed in SCC Suit No. 21 of 2000 between Ram Chandra Jaiswal and Sudeep Kumar Sahu. The said suit was filed for arrears of rent by the landlord. The matter was contested and by the aforesaid order a recovery of Rs. 30,000/ - as rent, Rs. 2,591/ - as telephone charges and Rs. 55,914 as electricity charges together with interest at the rate of 18% per annum was directed to be recovered from the tenant. Challenging the aforesaid order the present revision has been filed. Learned Counsel appearing for the parties have stated that during the pendency of the revision a compromise has been arrived at between the revisionist and the respondent. The said compromise has been filed through a joint affidavit filed by both the parties. Learned Counsel for the parties agreed that the revision be disposed of in terms of the compromise. The compromise is quoted in paragraph 4 of the affidavit dated 4.4.2011. Paragraph 4 is quoted herein below:
(2.) IN view of the aforesaid the facts and circumstances of the case, since a compromise has been arrived at between the parties and no cause of action still survives, therefore, the present revision is disposed of in terms of the aforesaid compromise.
