JUDGEMENT

(1.) THIS second appeal has been filed against the judgment and decree dated 6-9-99 passed by learned Additional Commissioner, Varanasi in Appeal No. 1 of 1992 district Sonbhadra arising out of a suit No. 97/1991 under Section 229-B of the U.P.Z.A. and L.R. Act.

(2.) BY the impugned order the Learned Additional Commissioner allowed the appeal, set aside the order dated 30-9-92 passed by S.D.O./Additional Collector First Class, Robertsganj in suit No. 97/1991 and dismissed the suit of the plaintiff.

(3.) I have heard the learned Counsel for the parties and perused the record.
