(1.) S. K. Agarwal, J. Heard learned Counsel for the applicant and learned A. G. A.
(2.) THE features of this case are strange. A peon of the same institution Sukhdev was delivered the cheques of two persons who had requested for withdrawal of certain amount from their G. P. F. ac count. That persons instead of handing over the cheques to the concerned persons or the Principal had themselves opened fake accounts in their names by affixing his own photographs with the applications forms introduced themselves as Ram Kishor and Bhulai. THE forms in the bank were signed as witnesses of identification by the Principal Sri Krishna Pratap Singh and the applicant and the other persons' form was signed as introductory witness by Ismail, a teacher of the school of the ap plicant. It raises a doubt in the mind that in all possibility, the Principal of the institu tion and the Ismail, teacher, were hand in glove and it was them who obtained signa tures probably by Bhulai and Ram Kishor on some pretext and have withdrawn the amount from their G. P. F. account and the cheques were also withdrawn by using the agency of Sukhdeo, peon, by these ac cused.
