JUDGEMENT

(1.) This writ petition has been filed with a prayer for mandamus directing the respondents to designate the petitioner as Lecturer since the date of his initial appointment as Instructor, i.e.. 24.4.1992 and to pay salary and other consequential benefits accordingly with retrospective effect. The petitioner has also prayed that he should be given the benefit of the G.O. dated 17.10.98 with retrospective effect,

(2.) We have heard learned counsel for the parlies.

(3.) The petitioner was appointed on 24.4.92 as Instructor in J.K. Institute of Applied Physics and Technology, University of Allahabad (hereinafter referred to as the Institute) after a selection by a Selection Committee as stated in para 3 of the petition and since then he has been continuing in service as such. In para 4 of the petition, it is stated that the pctilioner has a good academic record and he got first division upto to B. Tech. Degree which he obtained in 1990. In para 5 of the petition, it is stated that the duty of the Instructor are to teach students including teaching Engineering Drawing, Workshop and Surveying to B. Tech students and to look after practical classes. In this connection, the certificate issued by the Incharge, Workshop of the Institute is Annexure-1 to the writ petition.
