JUDGEMENT

(1.) THIS reference has been made by the learned Additional Commissioner, Jhansi by his order dated 10-2-97 passed in Revision No. 82/55 of 93-94 Banda recommending that the revision be allowed, the order of the trial Court dated 28-1- 92 be set aside and the allotments for abadi site in favour of the opposite parties be rejected.

(2.) I have heard the learned Counsel for the parties and perused the record.

(3.) AFTER perusing the record, I am inclined to agree with the view of the learned Additional Commissioner. Agreeing with the recommendation of the learned Additional Commissioner, I accept the reference, allow the revision, set aside the order of the trial Court dated 28-1-92 and cancel the allotments for abadi site made in favour of the present opposite parties. Revision allowed
