JUDGEMENT

(1.) S. K. Agarwal, J. Heard learned Counsel for the applicant and learned AGA.

(2.) THIS is a case in which the alleged recovery is 100 gm. Morphine. Admittedly this is a case of opium growing belt and the area is an industry in the manufacturing of the Morphin. It is shocking that when this applicant was arrested except an ornamental compliance of Section 50 of the N. D. P. S. Act no serious endeavour was made by the Sub-Inspector concerned to find out from whom this accused disclosed to obtain this Morphine. His name has been disclosed in the FIR as Kunnu alias Bulai. THIS case was completed without taking steps against Kunnu. Generally it is found in the majority of the F. I. Rs. that the police personal affecting the arrest of the carriers never tried to find out the real culprits who are running the industry in the narcotic and substances Drugs for the reasons best known to them.
